A late rent notice tells a tenant their payment is overdue, states the amount owed, and sets a deadline. It is usually the first formal step: a documented reminder that often resolves the issue without escalation. If payment still does not arrive, most states then require a specific statutory notice, commonly called a pay-or-quit notice, before an eviction case can be filed. Pay-or-quit notice periods by state

Late rent notice FAQ

Is a late rent notice the same as a pay-or-quit notice?
No. A late rent notice is a reminder you can send any time rent is overdue. A pay-or-quit notice is the formal statutory notice, with a state-mandated period, that must usually precede an eviction filing. Many landlords send the friendly reminder first and the statutory notice only if it goes unanswered.
When can I send a late rent notice?
As soon as rent is late under your lease, after any grace period the lease or your state provides. Some states have statutory grace periods of a few days; check the table above and your lease.
What should a late rent notice include?
The tenant’s name and unit, the amount owed, the period it covers, the original due date, a payment deadline and method, and a signature. Keeping the tone factual and professional makes payment more likely and reads better if the letter is ever shown to a court.
Can I charge a late fee?
Only if your lease provides for it and your state allows it. Several states cap late fees or require a grace period before they accrue. The template’s account summary includes a late fee row; keep it only if your lease and state rules support the fee, and delete the row otherwise.
